Bad Behavior at Mediation

Tips when confronted with bad behaviour at mediation:

  1. Don't take the "bait" by reacting "in kind"

  2. Maintain civility and professionalism

  3. Attempt to redirect the discussion back to the issues and seek "reasoned" explanations for the positions being taken

  4. Use your mediator to assist in moving the negotiations away from "positional" to "interest-based" bargaining

  5. If none of that works, end the negotiations - "no deal" is almost always better than a "bad deal"!
